Threatened Constitutional Separation of Powers: Demand for an Urgent Investigation into the BIA

GP Solidarnost demands the immediate suspension of the Security Information Agency (BIA) and the launch of an independent investigation, monitored by international observers, into the alleged misuse of this agency for political purposes. If the allegations concerning the summoning of prosecutors to the BIA ahead of the vote on the High Prosecutorial Council — publicly addressed by the Republic Public Prosecutor — are confirmed, this would constitute direct and unlawful interference by the executive branch in the work of the judiciary, aimed at shielding Aleksandar Vučić and the leadership of the SNS from criminal liability. Such conduct represents a serious attack on the constitutional order of the Republic of Serbia and requires urgent clarification of the following:

  • whether impermissible pressure by the executive branch has undermined the constitutional guarantee of prosecutorial independence,

  • whether unconstitutional conduct by executive authorities has occurred,

  • whether there are elements of criminal offenses, including abuse of office, unlawful influence, obstruction of justice, and endangering the independence of the judiciary,

  • whether the Law on the BIA has been violated through serious breaches of official duty and the exceeding of statutory powers.

If the allegations of pressure on prosecutors are confirmed, Serbia is facing serious elements of authoritarian governance and the de facto abolition of the separation of powers. We call upon the competent domestic authorities and international institutions to react without delay. This is not a matter of political conflict, but a matter concerning the survival of the constitutional order and the rule of law in Serbia.
